or legal reasons. This Privacy Policy is incorporated
into and subject to the terms of WhyWire's Services Agreement.

will control. WhyWire is the sole operator of this web
site and is the only entity that collects and maintains

2. INFORMATION WE COLLECT
We do not sell, rent, or in any way share
personally identifiable information about you to any
third party outside of WhyWire, its parent, affiliates,
subsidiaries, operating companies and related entities.
Throughout the site, if you choose to register, you
are identified by your User ID. Your User ID can be
used to identify your activities throughout the site.
We cooperate with all law enforcement inquiries and
with all third parties to enforce their intellectual
property or other rights. Once you register, you will
be able to review and change much of your personally
identifiable information at our site. We collect your
information in different areas of our site. The exact
information collected varies, depending upon the area
you are using. However, our users should be assured
that we do not use, or view any information or content,
such as video, audio, images, text, or other files,
that you upload and store in the course of using our
services. When you register for our services or order
a product from our site, we must know your name, e-mail
address, billing address, and credit card number plus
expiration date. We collect this information in order
to bill your credit card for services you subscribe
to, and to ensure that your credit card is not being
used fraudulently. Additionally, we will need to know
how much disk space you are using on our server, how
many devices (i.e., cameras, sensors, etc.) you have
connected to our system, and how many times each month
you are notified of an event. In our online registration
form, we require you to provide us with your full
name, billing address, phone number, e-mail address,
a password and a User ID. We may also request that
you provide us with other personal information. Again,
submission of this additional personal information
is purely optional and refusal will still allow you
to continue using our site. From time to time we may
sponsor contests or other promotional activity. When
and if you participate in a contest or other promotional
activity, we must know your name, postal address and
e-mail address so we can properly administer the contest
and notify winners. In the course of using our site,
we automatically track certain information about you.
This information includes the URL that you just came
from (whether this URL is on our site or not), which
URL you go to next (whether this URL is on our site
or not), what browser you are using, and your Internet
Protocol (IP) address. Many sites automatically collect
this information. In addition, we use cookies on certain
pages of our site. Among other functions, cookies
allow you to enter your password less frequently during
a session. Cookies can also help us provide information
which is targeted to your interests. Cookies are stored
on your hard drive, not on our site. Most cookies
are "session cookies," meaning that they
are automatically deleted at the end of a session.
You are always free to decline our cookies if your
browser permits, although in that case you may be
required to reenter your password more frequently
during a session. If you choose to post messages on
our newsgroups, we will collect the information that
you voluntarily choose to disclose. If you send us
personal correspondences, such as e-mails or letters,
or if other users or third parties send us correspondence
about your activities or postings on the site, we
may collect such information in a file specific to
you. Such information will be personalized to enable
us to respond to your inquiries in a personal manner.
There may be other forms and sources of information
we collect about you, depending on how you use the site.
3. OUR USE OF YOUR INFORMATION
We may internally use personally identifiable
information to improve our services, to statistically
analyze site usage, to improve our content and to
customize our site's content and layout. We believe
these uses might allow us to improve our site and
better tailor it to meet our users' needs. We may
also use personally identifiable information to deliver
information to you that, in some cases, is targeted
to your interests, such as targeted banners and promotions.
If you supply us with your e-mail address, you may
receive occasional e-mail from us announcing product
information, promotional events, or updates to our
web site If you do not wish to receive such mailings,
please send an e-mail to unsubscribe@why-wire.com
indicating that you do not want to receive such information.
We may use your e-mail address and, in rare situations,
your postal address or phone number, to contact you
regarding administrative notices from time to time.
We use information in the file we maintain about you,
and other information we obtain from your current
and past activities on the site, to resolve disputes,
troubleshoot problems and enforce our Services Agreement.
4. OUR DISCLOSURE OF YOUR INFORMATION
We do not sell, rent or in any way share any
personally identifiable information about you to any
third party outside of WhyWire, its parent, affiliates,
subsidiaries, operating companies and other related
entities. We do aggregate personally identifiable
information and disclose such information in aggregate
to advertisers and for other marketing and promotional
purposes. However, in these situations, we do not
disclose to these entities any information that could
be used to personally identify you. Certain information,
to the extent we have received it from you, such as
your password, and credit card number, are not disclosed
in aggregate at all. Unfortunately, due to the existing
regulatory environment, we cannot ensure that all
of your private communications and other personally
identifiable information will never be disclosed in
ways not otherwise described in this Privacy Policy.
By way of example (without limiting the foregoing),
we may be forced to disclose information to the government
or third parties under certain circumstances, or third
parties may unlawfully intercept or access transmissions
or private communications. Further, we can (and you
authorize us to) disclose any information about you
to law enforcement or other government officials as
we, in our sole discretion, believe necessary or appropriate.
Therefore, although we use industry standard practices
to protect your privacy, we do not promise, and you
should not expect, that your personally identifiable
information or private communications will always
remain private.
5. CONTROL OF YOUR PASSWORD
You may not disclose your password to any
third parties or share it with any third parties.
If, despite the foregoing, you lose control of your
password, you may lose substantial control over your
personally identifiable information and may be subject
to legally binding actions taken on your behalf. Therefore,
if your password has been compromised for any reason,
you should immediately change it, as detailed below
in paragraph 6, "Reviewing and Changing Your
Personally Identifiable Information".
6. REVIEWING AND CHANGING YOUR PERSONALLY IDENTIFIABLE INFORMATION
Once you register, you will be able to review and
change much of your personally identifiable information
at our site. Some information that you have requested
us to remove will remain in our files. We will retain
this information for very limited purposes, such as
to resolve disputes, troubleshoot problems and enforce
our Service Agreement. Further, such prior information
is never completely removed from our databases due
to technical constraints and the fact that we back
up our systems. Therefore, all of your personally
identifiable information will not be completely removed
from our databases in response to your requests. Please
promptly update your information with us if it changes.
7. THIRD PARTY COLLECTORS OF INFORMATION
WhyWire's privacy policy only addresses the
use and disclosure of information given to WhyWire.
To the extent that you disclose your information to
other parties, whether they are other users, merchants
or advertisers on our system or on other sites throughout
the Internet, different rules may apply to their use
or disclosure of the personal information you give
to them. To the extent that we use third party merchants
and advertisers, they adhere to their own privacy
customs and policies. Because we do not control the
privacy policies of third parties, you are subject
to their privacy customs and policies. We encourage
you to ask questions before you disclose your personal
information to others.
8. SECURITY
We use industry standard efforts, such as
firewalls and Secure Socket Layers, to safeguard the
confidentiality of your personal identifiable information.
When you register for our services, place an order,
access your account information or send us personally
identifying data, that information moves to a secure
server where it is protected from unauthorized access.
However, "perfect security" does not exist
on the Internet. When using wireless cameras, you
should be aware that information flowing between the
wireless camera and the WhyWire System Controller connected
to your computer, is not secure. This information
can be intercepted by various devices currently available
in the market. WhyWire is not liable for damages resulting
from the unauthorized interception of such information
by third parties. Due to the nature of current technology,
there exists the possibility of unauthorized access
to your computer by third parties. As such, all data
on your computer, including WhyWire Home Control software,
and related connections, can be comprised. WhyWire
is not liable for damages resulting from the unauthorized
access to your computer, and related WhyWire software
and hardware by third parties.
